LIABILITY WAIVER
ASSUMPTION OF RISK, WAIVER & RELEASE OF LIABILITY, INCLUDING NEGLIGENCE
I acknowledge and accept that as a participant in a Beyond Skagway Tours and it’s related operators, service providers & employees including without limitation, Peter Hines & Tao of Light Photography & Tao of Light Photo Art Ventures [dba Beyond Skagway Tours, LLC hereafter referred to as “BST”] photography tour/workshop; I am a healthy adult, voluntarily participating in this photography tour/workshop and I assume all risks of illness, injury, death, damage and/or loss to myself or my property that might result. On behalf of myself and my personal representatives, heirs, executors, administrators, agents and assigns, I hereby release and discharge in advance BST (and its owners, employees, instructors, agents, representatives and assigns) from any and all liability, even if that liability arises out of negligence and/or carelessness on the part of the persons or entities mentioned above. I take full responsibility for my behavior, well being, and health throughout the booked photography tour/workshop, which may involve some, but not all, of the following possibilities: (1) a variety of activities, unfamiliar locations, and modes of locomotion, including but not limited to: climbing, running, or walking for a longer period of time than I am used to, physical exertion for which I may not be prepared, traversing uneven ground, with or without photographic/video equipment in order to access off-road sites and weather extremes subject to sudden and unexpected change; (2) natural hazards, such as, but not limited to, steep cliffs, ice, snow, oceans, rivers, streams, hazardous footing, busy roadways, dimly lit building interiors and exteriors, and/or wildlife; (3) transportation to and from locations; and, (4) negligent instruction and/or supervision by any of the persons involved in the tour/workshop on behalf of BST. In addition, I acknowledge the tour/workshop requires a minimum of 4-6 clients to run at stated pricing and will not hold liable or responsible BST for disruption to client vacation planning or arrangements resulting from cancellation of trip due to lack of booked clients. I also take full responsibility for satisfaction in my photographic work and acknowledge that my photographic opportunities and quality of photographic work may be directly affected positively or negatively by such factors as my motivation, level of equipment and skill as well as such factors as unpredictable weather & availability of wildlife, etc. I acknowledge that the enjoyment and excitement of the proposed form of tour/workshop is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness, the BST or their Staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. Further, I agree that at all times during the tour/workshop, I will abide by and comply with any additional instructions given by the tour guide or any other Staff and accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour/workshop. By reserving the BST photography tour/workshop, I enter into this Liability Waiver, and am not relying on any oral, written nor visual representations or statements by BST or their Staff or any other inducement or coercion to go on the photography tour/workshop. I agree that this Liability Waiver supersedes any other agreements or representations by or between the parties, in writing or oral on the same subject matter, and can only be modified in writing in a document signed by both parties. I confirm that, by my own free will, I have read and understand the Terms and Conditions of the Liability Waiver and agree that this Liability Waiver will be binding upon my heirs, next of kin, executors, administrators and successors now and in the future. In addition, I agree to grant BST to a worldwide, royalty-free license to use my photographic, video, or digital likeness solely for promotional and educational purposes.
We recommend trip insurance purchased from a third-party operator to protect your travel investment against medical emergencies, attendee trip cancellations, travel delays, and emergency evacuation coverage. All tour cancellations must be submitted in writing and will result in loss of deposit. Full tour fees are non-refundable if cancelled within 90 days prior to start of trip.
Full tour payments must be completed 90 days prior to the start of the tour/workshop and are paid by check or bank transfer.
I have carefully read this Assumption of Risk, Waiver and Release of Liability, Including Negligence. I am aware that both predictable and unpredictable risks are involved during the tour/workshop, field outings, sub-tours, etc conducted on behalf of Photo Tour Partners.
